Product Usage and Warnings

The Phoenix is not a toy, it is a medical device which emits powerful sound waves. These sound waves are safe if used as intended but may be dangerous and harmful if used improperly. The Phoenix must only be used in accordance with the printed and video instructions which are included with the product and which are available on the Company website. To avoid injury or harm you must:

  • ONLY use the Phoenix as directed.
  • ONLY use the Phoenix after consulting with a physician to confirm that it is safe for you to do so.
  • NEVER place the tip or any other portion of the Phoenix on any part of your body other than those body parts and locations specifically called out in the operating instructions.
  • NEVER place the tip or any other portion of the Phoenix on your eyes or ears or anywhere on your face or head.
  • NEVER use the Phoenix in or near standing or running water as this may pose an electrical shock hazard.
  • NEVER insert the Phoenix in any orifice of yours or anybody else’s body.
  • NEVER use the Phoenix more frequently than directed in the operating instructions or as advised by a competent medical professional.
  • NEVER use the Phoenix in a small enclosed space without using hearing protection as the device emits loud noise which could damage your hearing.

You must not:

  • Republish material from The Phoenix.
  • Sell, rent or sub-license material from The Phoenix
  • Reproduce, duplicate or copy material from The Phoenix
  • Redistribute content from The Phoenix (unless content is specifically made for redistribution).

No use of The Phoenix’s logo or other artwork will be allowed for linking absent a trademark license agreement.

Reservation of Rights

We reserve the right at any time and in its sole discretion to request that you remove all links or any particular link to our website. Refund Policy

The Phoenix is covered by a "60 Day Manufacturer`s Guarantee". If, within 60 days of your Phoenix arriving, you notice any manufacturing defects, please send an email to"support@launchmedical.com"

We will happily replace your Phoenix! Shipping is on us. Just send it back using the prepaid return label and we will replace it with a new one. If you are returning a device, please clean it. For the health and safety of our team, we reserve the right to refuse devices sent back to us in an unsanitary condition. Also, please do not return open packets of lubricant or numbing cream - they cause a mess in transit.

After 60 days, all sales are final.

Marketing Policy

You agree to be marketed to via phone call, voicemail, email, text, Facebook messenger, desktop notifications, and direct mail, unless you “opt-out” or unsubscribe. To “opt-out” or unsubscribe, please follow the directions stated in the marketing.

Shipping Policy

Orders are processed within 1-2 business days.

Domestic shipping normally takes 2-5 days after leaving our facility to arrive at your door. However, we have noticed some shipments delayed by circumstances related to COVID-19.

You will receive a tracking number once your order leaves our facility.

Return Policy, 60 Day Guarantee

You have 60 days from the date your order arrives to return The Phoenix for a complete refund (minus the $75 disposal fee).

If your device is defective, we will gladly exchange it during this same 60 day period (including free shipping).

60 days after an order leaves our warehouse, all sales are final.

Please note that damaged products cannot be returned. For this reason, we do not recommend storing your Phoenix upright on an elevated surface - if it tips or falls over, the stainless steel tip can be damaged.

We highly recommend purchasing our extended manufacturer`s warranty, which gives you a full year of coverage (excluding physical damage to the device).

If your product was damaged during shipping, please let us know right away.

To initiate a return:

Send an email to support@launchmedical.com for a return authorization. Once approved, we will email you a prepaid return label.

Refund requests are handled in the order they are received. The dates used to determine eligibility are (a) the date your order was shipped and (b) the date your email was sent, generating your support ticket.

The time it takes us to respond will not count against your 60 day window. We will honor your request as long as the product is not damaged and your original request arrived within the 60 day window.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:

  • limit or exclude our or your liability for death or personal injury resulting from negligence;
  • limit or exclude our or your liability for fraud or fraudulent misrepresentation;
  • limit any of our or your liabilities in any way that is not permitted under applicable law; or
  • exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

To the extent that the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.

ProGuard Terms and Conditions

ProGuard is an optional extended warranty that provides complete coverage for one year from the date your original Phoenix arrives at your door (verified via FedEx tracking). If the device stops working, contact a member of our 24/7 support team for assistance. We’ll troubleshoot with you and get the unit back to our lab for inspection if we can’t resolve the problem.

Accidental Damage

If you drop or damage your device, you are entitled to one incident of repair or replacement (at our discretion). The damaged unit must be returned. If it cannot be repaired, we will replace the unit with a new device at no cost to you.

Device Failure (Not Physically Damaged)

If your Phoenix fails or stops working, and it has not been physically damaged, contact a member of our 24/7 support team for a return authorization. Our lab will inspect your unit and repair it or replace it if necessary (at our discretion). If we find that the device has been physically damaged, repair or replacement will count against the accidental damage replacement limit.

Loss of Device

Loss or theft of your Phoenix is not covered by ProGuard. Your unit must be returned to us (domestic shipping is covered by us).

International Shipping

We are happy to cover domestic shipping costs within the United States. ProGuard coverage is limited to the United States. If your device is shipped or transported outside the United States, we cannot provide repair or replacement for two important reasons:

  • The cost of international shipping is not covered by your plan.
  • We do not provide documentation for, nor do we take responsibility for import/export fees. As a medical device, it is possible that the unit may be held up by customs when shipped internationally (either to our lab or back to you).

Accessories

ProGuard coverage is extended to The Phoenix (including the nose cone, stainless steel treatment tip, and power adapter). This coverage is not extended to accessories (i.e. medical-grade pump, extra supplies). If you have an issue, please contact a member of our 24/7 support team - we’ll do our best to help.
